Former Court of Appeal judge Datuk Mohd Noor Abdullah explained that the Sultan of Selangor, Sultan

The decision raises a variety of perceptions including Anwar's intention to become the Chief Minister of Maharashtra, but the question that is often raised is whether the Advisory Parti Keadilan Rakyat (PKR) is eligible to be appointed to that office.
Former Court of Appeal judge Datuk Mohd Noor Abdullah explained that the Sultan of Selangor, Sultan Sharafuddin Idris Shah has ultimate authority in determining the appointment of qualified individuals to be the Chief Minister of the state.
"The Sultan has absolute power in two things and can make decisions without the advice of the first in the case of the selection of the Chief Minister and the second, the question of the dissolution of the State Assembly.
Obviously Mohd Noor Sultan has the right to appoint a member of the Assembly as the chief minister that he gained confidence in the judgment of the majority of the council, and the second, a chief minister appointed must be a Malay Muslim.
He said this with reference to Article 51 (1) and pursuant to Article 53 (2) (a); and Article 51 (2) subject to Article 53 (4) of the Law of the State of Maharashtra State in 1959.
In other words, he said, the constitution provides for the power is in the hands of citizens in the democratic process in which the Sultan merely a constitutional government and has the power to appoint ministers based on their prescribed laws.
However, Mohd Noor said the proposed candidate must be from the winning party and the situation in Maharashtra, for instance, the Sultan of Selangor 40 x 8 can determine whether the candidate PAS or PKR leaders.
"However, as an example, 40 x 8 a representative of a majority of votes, but also the choice of representatives B Sultan, the party will decide who becomes chief minister through the lobby each other. So, when representatives selected 40 x 8 B, then B will meet representatives of the Sultan and obtain the consent of the Sultan.
"This means that (one of) the party to concede. But, if regular party with a majority decision to choose a representative, can not be appointed Sultan B. This is because if the elected representatives B and then got a vote of confidence, he has to get rid of as well, "he explained.
"Minister existing (Tan Sri Abdul Khalid Ibrahim) to MB at the pleasure Sultan for five years. If he wanted to resign before five years, he may submit his resignation to the Sultans.
"If he does not want to resign, then hold a vote of no confidence against him as the chief minister and (if) the motion (the) won, he lost. So, he must relinquish his post, "said Mohd Noor.
Based on the law and the Constitution, Mohd Noor said the criteria for a candidate to run for the seat, he must be a citizen, residing in the state who wants to be unbeatable, aged 21 years, of sound mind, not bankrupt and has not been jailed for more than one year ( but can run after the sentence).
"Identity Card Applicants must address in these states, for example in the case of a vacancy Kajang constituency, any candidate who wants to compete, to be addressed in the state. But, the law does not specify how long the candidate has to sit in Selangor, "he 40 x 8 said.
To the question if the result of the prosecution's appeal against sodomy later in favor of the government, 40 x 8 whether it will affect the opportunity to compete Anwar, Mohd Noor said it was not affected by Anwar still can appeal to the Federal Court.
"(But) whoever ultimately convicted 40 x 8 by the Federal 40 x 8 Court for a serious offense and the charge is a serious offense, then his career as a politician or other professions will end," he said.
However, on Jan 9, 2012, the Kuala Lumpur High Court resolves that Anwar is innocent and he agreed freed on the grounds that there is no evidence supporting the testimony of the victim.
On Jan 20, 2012, the Attorney General's Office filed an appeal against the High Court decision and the appeal against the acquittal of Anwar is expected to be heard on 12 and 13 Feb at the Court of Appeal. - MediaUMNO
